Date: October 31st 2011

The Deadly Weapons Recodification Act of 2010 (SB 1080 (Committee on Public Safety), 2010 Cal. Stat. ch. 711, reorganized the statutes governing control of deadly weapons, without changing their substance. The Act was drafted by the Law Revision Commission, at the request of the Legislature. It is scheduled to become operative on January 1, 2012.

To assist persons using the deadly weapon statutes, the Commission prepared a disposition table that lists each existing statutory provision and shows where that provision is being relocated. Since the Commission prepared that table, however, the Legislature has amended some of the provisions recodified by the Act.

The Commission's staff has therefore updated the disposition table to note these changes. The updated disposition table has been uploaded to the Commission's website and can be downloaded at the following web address:

• Disposition Table (updated to reflect 2011 legislation)

To further assist persons using the deadly weapon statutes, the Commission's staff has also prepared another table (a "reverse disposition table"), which lists each recodified provision and shows its source. This reverse disposition table has also been uploaded to the Commission's website and can be downloaded at the following web address:

• Reverse Disposition Table ("Source of New Law")

Most of the information in the reverse disposition table was already available in the Law Revision Commission's Comments to the recodified provisions. We hope that providing the same information in table format proves helpful.

Several legal publishers included the original version of the Commission's disposition table in their 2011 desktop and annotated versions of the Penal Code. Publishers may wish to include the updated disposition table, and perhaps also the reverse disposition table, in their 2012 desktop and annotated versions of the Penal Code.

For an explanation of how the deadly weapon statutes were reorganized, see the 31-page preliminary part of the Commission's report, which can be downloaded at the following web address:

Further information regarding the Deadly Weapons Recodification Act, including the final published version of the Commission's 1,099-page report, is available at <www.clrc.ca.gov/M300.html>.

If you have any questions or comments regarding these matters, please contact Barbara Gaal at (650) 494-1335 or <bgaal@clrc.ca.gov>. The Commission is particularly interested in being notified of any errors in the disposition table or reverse disposition table, so that such problems can be corrected promptly to prevent confusion.

Thank you for your interest in the Commission's work.
