Exemptions from Enforcement of Money Judgments:
Second Decennial Review - Study D-355
The Commission is required by statute to conduct a review of exemptions from
execution and recommend any needed revisions in exempt amounts. The Commission has now completed its
second decennial review.
The Commission recommends that the amount of the personal property exemptions
be increased by approximately 20% to keep pace with inflation. The Commission also recommends that
these amounts be indexed in the future to changes in the cost of living, so that periodic legislation
to adjust them will be unnecessary. The Commission will propose implementing legislation for the 2003
legislative session.
